Terms & Conditions

For the purpose of these terms and conditions, the following words shall have the following meanings: –

‘us/we’ shall mean Godalming Kitchens

‘you’ shall mean you: the customer (the person or organisation for whom we agree to carry out works and/or supply of materials)

‘our representative’ shall be the person we send to do the work.

1) Payments Terms

Stage 1. A 60% deposit of your quote total will be due for payment once the quote has been accepted and you are ready to proceed. Upon receipt of the deposit payment, Godalming Kitchens acknowledge your acceptance of our payment terms as set out below.

Stage 2. A 30% stage payment is required prior to commencement of work on site. Please allow sufficient time for your funds to have cleared into our bank account by the arranged start date but no later as this will delay works. This date is the date we intend to start work but may be revised with your prior agreement.

Stage 3. A final 10% payment will be invoiced on satisfactory completion of your installation.

The three stage payment terms will enable us to order all the relevant units, appliances and material pertaining to your specified design and installation requirements.

All goods are ordered upon receipt of your deposit payment; a delay in receiving your deposit will delay your goods being ordered and will impact your start date. Please note delayed stage payments will affect the timescales relating to the completion of your work.

Payments are accepted via cheque or BACS transfer.

2) Returns Policy

  • Only goods that are faulty or damaged can be returned, only in certain circumstances with the discretion of Godalming Kitchens can goods be returned that are not faulty or damaged.

  • Any goods returned will be subject to a 25% handling charge if not found to be faulty or damaged.

  • Goods can only be returned unopened, in a saleable condition in the original packaging within 28 days of being delivered to us.

  • Goods that are not to be installed by Godalming Kitchens (supply only) should be checked at the time of delivery and signed for.

  • Any damages or faults should be reported within 24 hours of delivery or installation / fitting.

3) Supplies

Please note that our suppliers and their products could be changed, delayed or discontinued at any time with little or no notice to Godalming Kitchens. This may include but are not limited to product specification changes and supply chain availability as well as items delivered to us damaged.

Godalming Kitchens will do our upmost to avoid any alterations or delays to your original quote or installation as a result of the above.

Godalming Kitchens would be unable to accept responsibility for any such eventualities which may result in a delay on your project start date, increase in price on original quote or any costs incurred by yourself as a direct or indirect result of the before mentioned.

4) Installations

Whilst we take every precaution to keep your project on track, there may be unforeseen circumstances that could arise once work commences, these will include but are not limited to:

  • Access – please ensure we have access to the property on the dates arranged with the installations manager. If you are not able to be home but are happy for us to continue works in your absence, please provide a key and any special instructions to be passed on to the team.

  • Parking – please ensure there is parking available for the installations team; if parking is restricted please provide parking permits prior to start date and for the duration of the works.

  • Floors – if we find that a floor cannot be tiled or would require additional works to secure it, you will be consulted as this may incur additional cost for materials / labour and will affect the timing of your project.

  • Walls – we may find once your current wall coverings are removed that the wall would need additional plastering / skimming. We will consult you as this may incur additional cost for materials / labour and will affect the timing of you project.

  • Plumbing – if we find that your current plumbing would need updating or adjusting outside what has been quoted or planned for, we will consult with you as this may incur additional cost for materials / labour and will affect the timing of you project.

  • Electrics – if we find that your current electrics need updating or adjusting outside what has been quoted or planned for, we will consult with you as this may incur additional cost for materials / labour and will affect the timing of you project. Our works will comply with 18th Edition Wiring Regulations.

  • On-site alterations and deviation to your original design; if you change your mind about something after works have started, or if any changes are made on-site which may include the return of items and order of replacements, we will consult with you as this may incur additional cost for materials / labour and will affect the timing of you project.

  • In addition to the above also see Payment Terms & Supplies which could potentially delay your project.

  • Bespoke items cannot be returned unless faulty or damaged

5) Floor and wall covering

  • Tiles may vary slightly in colour if from different batches (including samples). It is always advised to order all floor and wall tiles from the same range at the same time to ensure they are from the same batch.

  • If a floor is to be tiled, very occasionally after removing your current flooring we may find that the floor base is not in a suitable condition (this may be due to joists etc). Alternatives can be recommended by your designer. This may include additional works and /or increase the cost of your original quote. With your prior agreement these alternatives will be implemented.

  • Karndean flooring; depending on the state of your current floor, your floor may or may not require latexing (to even out your floor level). Where latex is required, one or more applications may be required and will only be established upon the first visit.

If found that more than one application is required necessary adjustments to you installation date will be made and this will impact on the completion date which will be beyond our control. Latex dries within 3-4 hours depending on thickness, please check with the office if you’re not sure. * Please familiarise yourself with any care instructions or ask a member of staff.

6) Worktops

Granite worktops may vary in striations (linear patterns) due to the natural nature of the material (including samples). It is to be expected that a larger slab of your chosen worktop will have different striations than a small sample. A factory visit can be arranged by our office if you wish to see a much larger slab or your chosen granite.

7) Furniture

Furniture supplied only or supplied and fitted should always be the same finish and colour unless from different ranges as per your design. If you have noticed any variations, please alert your sales representative as soon as possible within 24 hours of installation or delivery in the case of supply only.

Painted ranges: Due to the nature of the product and manufacturing processes, there could be minor differences. These should not be of a significant nature and if such you should report any issues within 24 hours of installation or delivery in the case of supply only.

8) Collecting Materials for the Job

We try to minimise collection of materials by carrying everyday stock items. If we do need to collect materials we will always keep time to a minimum.

9) Fixed Price Work

Quotations will include labour and materials. The price will be fixed but manifest errors shall be exempted. Quotations may need to be revised if you change the scope of the work, if there is an increase in the price of materials, or if further works turn out to be needed to complete the work.

    • On work where the quotation value is in excess of £1,000, a deposit of 60% will be required with the order. A further 30% of the total quoted price will be required on commencement of work and the final 10% balance will be paid on completion as per our Payment Terms (Item 1).
    • The quotation amount where a deposit is required can be changed at our discretion.

10) Current Regulations

Under current regulations you have a 14 day cooling off period during which time you have the right to cancel. You must provide notice of cancellation in writing and it must be posted to, faxed or e-mailed to our business address. If you have commissioned works and these works begin before the end of the 14 day cancellation period, then you will give up your right to cancel.

11) Previous Quotation

If it is impossible for us to do the work for the previously quoted fixed price, we will give you a free quotation for the work, so you can choose to use us or not. If you decline the quotation, there will be no charges payable by you.

12) Payments

Invoices are payable immediately as per our Payment Terms (Item 1). Invoices unpaid (in total or in part) will be subject to a late payment compensation fee of 8% over the current Bank of England base rate on the full amount while any payment remains. There will also be a recovery charge if a Debt Collection Agency has to act on our behalf.

13) Guarantee

We provide a 12 month guarantee on our labour and the duration of the manufacturer’s guarantee for all the parts and equipment supplied by us. Regarding parts warranted by the manufacturer; we may charge labour if we have to replace them.

If you are not satisfied with our work, you must contact us within 24 hours of completion and let us come and inspect the work and carry out the necessary remedial work at our expense. You agree to let our insurers inspect any works carried out by us. Any snagging reported after that period may be charged for.

Things we cannot cover:

  • We are unable to guarantee our work, parts and equipment supplied to you if they are misused, treated negligently or if our work is repaired, modified, or tampered with by anyone other than us.

  • Where we carry out works for you using your materials we cannot accept responsibility for the quality, fitness for purpose or otherwise of these materials.

  • If a manufacturers part that we have supplied fails, we will charge for the cost of the labour to replace the part unless the manufacturer replaces it at their own cost.

  • We cannot guarantee work where you order us to carry out work against the advice of our representative. This advice will be given to you either orally, or in writing. Our guarantee is also void if we indicated that further works need to be carried out.

  • We cannot guarantee (because of its nature) any work to unblock waste or drainage pipes. Nor can we guarantee further damage or defects caused by work that is not fully guaranteed or where recommended further work has not been carried out.

  • We cannot guarantee work on existing installations that are either inferior or over 10 years old nor can we guarantee the effectiveness or otherwise of our work in these cases.

  • We will only be liable for rectifying our own work and shall not be held responsible for any ensuing damage or claims resulting from this or other work overlooked or subsequently requested and undertaken at that time.

  • We shall be entitled to recover the costs or damages from any person or contractor whose negligence or faulty workmanship makes us liable to pay for those damages.

  • We reserve the right to refuse or decline to undertake any work

  • We reserve the right, at our absolute discretion, to choose who will represent us.

14) Title to the Goods

  • Goods supplied and delivered by us to you, or your premises, shall remain our property until paid for by you in full. Whilst goods remain our property (we continue to have title over them) we have the absolute authority to retake, sell or otherwise dispose of all or any part of these goods.
  • We shall be entitled to seek a court order to prevent you from selling, transferring or otherwise disposing of such goods. However, the risk in the goods will pass to you on delivery to you. You must insure them at replacement value and if asked you must produce evidence that they are properly insured.

15) General

  • We will make every effort to attend each job at the time and date agreed with you according to our standard terms and conditions of sale. However, we cannot accept liability for either arriving late or not at all and for the late delivery or failure to supply materials.
  • You will personally be deemed to be our customer unless it’s made clear to us who the customer is and we have confirmation that you have the right to instruct us on their behalf.
  • If you instruct us to do work or buy materials and then cancel, we reserve the right to charge you for the cost of any time and materials incurred by us. Charges will be those of our normal terms and conditions.

16) Force Majeure

Neither party will be liable for performance delays nor for non-performance due to causes beyond its reasonable control, except for payment obligations.

Snagging Period

When a job has been completed, any snagging must be reported to us within 24 hours of completion. Any snagging reported after that period may be charged for.

These terms and conditions may not be released, discharged, supplemented, interpreted, varied or modified in any manner except by an instrument in writing signed by our duly authorised representative and you. Our terms and conditions shall prevail over any terms and conditions used by you or contained, set out or referred to in any documentation sent to us by you. By entering into a contract with us you agree irrevocably to waive the application of any of the terms and conditions sent to us by you.

These terms and conditions and all contracts awarded between us and you shall be governed and constructed in accordance with English Law and shall be subject to the exclusive jurisdiction of English Law.

Privacy Statement & (GDPR) General Data Protection Regulation

1. Godalming Kitchens will under no circumstances share your personal data with any third party. The only personal data we keep in electronic and paper format will be (Full name(s), Full Address, Phone Number(s), Email Address(s) WE DO NOT STORE ANY BANK DETAILS.

2. By accepting a Godalming Kitchens quote, you are agreeing to Godalming Kitchens retaining your personal data and use it in the following processes:

2.1 To comply with the minimum retention period set out by HRMC for VAT purposes (Minimum of 6 years records from the current year).

2.2 To qualify you (the customer) for any outstanding product warranties you may be eligible for. (Maximum of 10 years from the current year on specific items only – Masterclass in particular)

2.3 To contact you during your consultation, quotation, installation and after care processes.

2.4 To offer you consistent customer care and support when you contact us with enquiries relating to products and services current and historic (maximum 10 Years).

3. In May 2018 a new EU regulation came into force, the GDPR – General Data Protection Regulation which gives you (the customer) the following rights:

3.1 The Right To Be Forgotten

EU citizens will be able to request the controller (Godalming Kitchens) to not only delete your personal data but to stop sharing it with third parties, who are then also obligated to stop processing your personal data. (see point 1.)

3.1.1 By invoking your ‘Right to be forgotten’ after 6 years (see point 2.1) Godalming Kitchens will destroy all personal data. This will include but will not be limited to: Your personal data (point 1) and any quotes, plans, delivery notes as well as any related documentation whether paper or electronic pertaining to you (the customer) Please note that you personally would have to keep details of warranties that are still ‘active’ beyond this point .

3.2 Consent

Godalming Kitchens is required to obtain your consent to store and use your data as well as explaining how it is used. (see point 2)

3.2.1 By accepting a Godalming Kitchens quote, you will be required to sign a copy of the quote which makes reference to our Terms, Conditions and Policy’s as well as Privacy, Data Protection and GDP Regulations. Verbal consent or digitally signed consent forms are other methods of consent and will be regarded as such.

3.3 Privacy by Design

Privacy by Design is a framework based on proactively embedding privacy into the design and operation of IT systems, networked infrastructure, and business practices.

3.3.1 Godalming Kitchens will process and save your electronic data on secure server(s) which security protocols are regularly monitored and updated. Data is only accessible by our office staff and dedicated IT engineers.

3.3.2 Data back-ups are stored off-site on secure server(s) and only accessible to our dedicated IT

3.3.3 Paper records / data which will be an exact replica of your electronic data and is stored in a secure room on-site and accessible to our staff only.
